Mine never even did it until I actively turned it on. I have a hard time seeing the issue with a completely optional feature.

I agree the feature in itself isn't an issue. The lack of knowledge how it really works might be though; potentially along with factory settings. SpotPass is nowhere described by nintendo as a commercial notification system.

Let me try to rephrase the problem that people are seeing with ads in SpotPass and with ads for Office and OneDrive in the "fun facts, tips, tricks, and more" of Windows 10. The setting is all or nothing, with no middle ground to the effect "Notify me about software updates and other events related to games I have purchased, but not about other products or services for sale."

The same seems to be true for many eshop newsletters, though in a milder form. They won't deny features that should be more or less essential to the experience, but rather just lack a good way to filter what's relevant.
